Under RERA, builders must link payment demands to construction milestones. Demand-based payment (not time-based) is mandatory for projects registered after May 2017. Track your project's progress and payment linkage here.
Payment Released so Far
If possession is delayed beyond the RERA-registered date, you are entitled to interest at SBI MCLR + 2% per month on all amounts paid (typically 10–11% p.a.).
You can file a complaint on the state RERA portal. No court fee required; most cases are disposed within 60 days.
Section 18 of RERA: You can demand a full refund with interest if the delay is unreasonable.
Section 31: Any aggrieved person (buyer, association, RWA) can file a complaint — not just the agreement holder.
Builder cannot make additional payment demands beyond what is in the RERA-approved payment plan.
The builder must deposit 70% of all collections in a dedicated RERA escrow account — check with your state RERA if this is being maintained.
Occupancy Certificate: Builder must obtain OC before giving possession. Demanding possession without OC is illegal under RERA.
